Transfer of Development Intensity

The TDI was adopted on January 23rd, 2017.

Purpose

The objective of TDI is to achieve future increase in development intensity, accomplished through the severance of such intensity from one part of the Town to another part of the Town. The TDI allows the Town to approve the exportation of non-residential square footage and/pr residential units from one area (Sending District) to an importation of said square footage and/or residential units to another area (Receiving District).

Sending Districts

  • View corridors are exposed
  • More environmentally sensitive areas
  • Are in close residential proximities
  • Preservation of natural landscape important
  • SEVERANCE of Development Intensity

Receiving Districts

  • Visual & environmental impact of increased development are able to be tolerated
  • Contains better traffic capacity and greater infrastrucutre
  • Topography can conceal more intense development
  • Development more desirable
  • TRANSFER of Development Intensity

Dual Eligibility Districts

  • Will either become Sending or Receiving Districts over time as individual cases are considered

Incentives

Development Itensity Bonuses will be accrued for parties who:
  • Set aside public land such as parks, trails, and open space
  • Set aside sites for a public facility such as fire stations, museums, libraries, public schools, etc.
  • Preserve landmark landforms
  • Preserve Open Space adjacent to Westlake Academy
  • Supports the Westlake Public Art Program by either sponsoring a Public Art Competition or donates/acquires Public Art for the Town

Who can participate?

Only Planned Development Zones are eligible to participate in the Transfer of Development Intensity.


Goals & Objectives

The TDI:
  • Preserves characteristic view corridors of Westlake
  • Off-sets massing by decreasing zoning use intensities in other districts
  • Preserves the environmental and visual character of the Town
  • Better manages traffic volumes generated by future development
  • Facilitate implementation of Comprehensive Plan elements such as open space, public facilities, roads, trails, etc.
